These Terms of Service govern your use of the Fnx Performance website and purchases from Fnx Labs LLC, doing business as Fnx Performance ("FNX," "we," "us," or "our"). By using the site or accepting these terms at checkout, you agree to them. If you do not agree, do not use the site or place an order.
Our Privacy Policy, Research Use Only Disclaimer, Shipping Policy, and Refund / Return Policy also apply. Review these policies before ordering.
You must be at least 21 years old, or the age of majority in your jurisdiction if higher, and legally able to enter into a contract. You must be a qualified professional or act on behalf of a laboratory, academic institution, or other facility conducting lawful in vitro research.
You confirm that your identity, contact, affiliation, billing, and shipping information is accurate and that you may lawfully purchase, receive, and use the products. We may request supporting information and hold or decline orders that do not meet these requirements.
All products are intended exclusively for in vitro laboratory research by qualified professionals. They are not for human or animal consumption or administration, and must not be used for diagnosis, treatment, or other therapeutic purposes.
Products are not offered as drugs, dietary supplements, foods, cosmetics, or medical devices. They are not FDA-approved to diagnose, treat, cure, prevent, or mitigate any disease or health condition.
We do not provide medical advice or instructions for dosing, injection, administration, or preparation for human or animal use. Support is limited to orders, shipping, product records, lot information, and research documentation.
Product descriptions, images, specifications, and certificates of analysis are provided to support research evaluation. Review the applicable product and lot documentation before ordering or using a product.
We may correct errors in product information, pricing, or availability. If an error materially affects an order, we will contact you or cancel and refund the affected order. Research information does not establish safety or effectiveness for human or animal use.
Nothing in these terms overrides an express written product guarantee or a remedy stated in our applicable policies.
Placing an order is a request to purchase. Checkout completion, a payment authorization, or receipt of payment does not by itself confirm acceptance. Orders remain subject to payment, inventory, recipient, and research-use review before fulfillment.
Prices are in U.S. dollars. Applicable discounts, shipping charges, and taxes are shown at checkout. Prices may change for future orders. You must be authorized to use the payment method provided.
We may hold, limit, or cancel orders for suspected fraud, inaccurate information, unavailable stock, pricing errors, or research-use and legal concerns. Amounts paid for cancelled, unfulfilled products will be refunded in accordance with applicable law and our refund policy.
We ship to eligible U.S. recipients under our Shipping Policy. You are responsible for providing a complete, accurate delivery address and ensuring you can lawfully receive the order.
Delivery dates are estimates. Report delayed, damaged, missing, or incorrect shipments promptly with your order number, tracking information, and relevant photographs. Shipping offers, eligibility, and issue resolution are governed by our Shipping Policy.
Contact support promptly if you need to cancel an order before fulfillment. Cancellation may not be possible after processing or shipment.
Research products require controlled handling and storage, so returns are limited. Do not send a product back without written authorization. After shipment, damage, missing or incorrect items, documentation issues, and fulfillment errors are reviewed under our Refund / Return Policy.
These terms do not limit any applicable written guarantee or rights that cannot lawfully be excluded.
If there is a problem with a charge or order, contact support so we can investigate and help resolve it. Please provide accurate information and supporting records.
Nothing in these terms prevents you from exercising lawful chargeback, billing-dispute, or other payment rights. We may investigate suspected fraudulent transactions and provide relevant order records to payment providers as permitted by law and our Privacy Policy.
You are responsible for evaluating product hazards, following applicable laws and institutional requirements, and using appropriate laboratory procedures for handling, storage, transport, and disposal.
You must not administer products to people or animals; prepare them for human or animal use; market them with therapeutic claims; or resell, repackage, relabel, or redistribute them without our written authorization. Do not remove or obscure lot numbers or other product identifiers.
You must not misuse the site, gain unauthorized access, interfere with its security or operation, submit fraudulent information, or infringe another party's rights. We may refuse or suspend service when there is a reasonable concern about misuse or unlawful activity.
Keep your account credentials secure and notify us promptly of suspected unauthorized access. You are responsible for the accuracy of information supplied through your account and for activity you authorize.
Our Privacy Policy explains how we handle personal information, order records, and communications. Third-party services may also have their own terms and privacy policies.
FNX and its licensors retain their rights in the site's branding, text, images, software, and other content. You may use product documentation for lawful research evaluation and recordkeeping. Other reproduction, commercial distribution, or use of our branding requires permission unless allowed by law.
Any content you submit must be accurate, lawful, and yours to share. It must not infringe others' rights or promote prohibited product uses. If you submit a review for publication, you permit us to display it in connection with the relevant product or service. We may remove unlawful or misleading submissions.
Except for express written guarantees and rights that cannot be excluded by law, the site is provided as available without a promise of uninterrupted or error-free access. We do not guarantee a particular research outcome or suitability for a user's specific experiment.
To the extent permitted by law, FNX is not liable for indirect or consequential losses, including lost profits, business opportunities, or data arising from use of the site or products. Subject to applicable law, our aggregate liability for a claim is limited to the greater of the amount paid for the product giving rise to that claim or $100.
These limitations do not reduce an express written guarantee or exclude liability that cannot legally be limited, including liability for fraud or willful misconduct.
To the extent permitted by law, you agree to reimburse FNX for reasonable losses and costs arising from third-party claims caused by your unlawful product use, material breach of these terms, or infringement of another party's rights. This does not apply to losses caused by FNX's own unlawful conduct or breach.
Please send concerns or disputes to support@fnxperformancelabs.com with relevant order details and the resolution you seek. We will attempt to resolve them in good faith. This does not restrict access to a court, regulator, or any other remedy available under applicable law.
Events outside our reasonable control, such as severe weather, carrier disruption, or utility outages, may delay performance. We will communicate material order delays and provide cancellation or refund options where required by law.
We may update these terms by publishing a revised version and effective date. Material changes will be brought to your attention where required by law. Changes apply prospectively and do not retroactively remove rights relating to earlier purchases.
If a provision is unenforceable, the remaining provisions continue to apply. Failure to enforce a provision is not a waiver. These terms and the policies referenced here form the agreement governing your use of the site and purchases, subject to any applicable written product guarantee.
We may restrict or terminate access for a material breach, suspected fraud, or unlawful use. Accrued obligations and provisions intended to continue after termination remain effective.
